Terms of Use

1. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to enter into a service agreement with us. If you are between 13 and 17, you may browse the Site only with the consent and supervision of a parent or legal guardian. We do not knowingly collect information from children under 13.

2. The Services We Provide

CLARUS provides residential, vacation rental, commercial, and post-construction cleaning services in Southwest Florida, including Cape Coral, Fort Myers, Fort Myers Beach, Naples, and Punta Gorda. The Site provides information about those services and lets you request a quote or contact us.

Quotes are estimates based on the information you provide and may be adjusted on-site if conditions materially differ. Pricing, scope, and scheduling are confirmed before service begins. Nothing on the Site constitutes a binding offer of service until we accept your request in writing or by email.

3. Satisfaction Guarantee

If you are not satisfied with a completed cleaning, contact us within 24 hours of service. We will return and re-clean the affected area at no additional charge. The guarantee covers the scope agreed in your written quote and does not extend to pre-existing damage, items requiring specialized restoration, or work outside the agreed scope.

4. Site Content and Intellectual Property

All text, images, logos, graphics, and software on the Site are owned by CLARUS or our licensors and are protected by copyright, trademark, and other intellectual property laws. You may view and print pages for your personal, non-commercial use only. You may not copy, modify, distribute, sell, or otherwise exploit any portion of the Site without our prior written permission.

The CLARUS name and logo are trademarks of CLARUS Cleaning Services. Third-party trademarks shown on the Site (for example, references to Airbnb, VRBO, or service partner names) are the property of their respective owners.

5. Permitted and Prohibited Use

You agree to use the Site only for lawful purposes and in a way that does not infringe the rights of others or restrict their use of the Site. In particular, you agree not to:

• ●Attempt to gain unauthorized access to any part of the Site, account, server, or system
• ●Upload or transmit viruses, malware, or harmful code
• ●Use scrapers, bots, or automated tools to extract content from the Site
• ●Resell or redistribute Site content without our permission
• ●Interfere with the operation of the Site or any user’s use of it

6. Communications

When you contact us through the form on the Site, by phone, by email, by WhatsApp, or by SMS, you consent to receive responses through any of those channels. Standard message and data rates may apply. You can opt out of non-transactional marketing messages by replying STOP to a text message or by emailing us at the address in the contact section. Transactional messages tied to a service you have requested or scheduled may continue.

7. Third-Party Links and Services

The Site may include links to third-party websites or embedded services such as Google Maps, social media platforms, or messaging tools. We do not control those third parties and are not responsible for their content, terms, or practices. Your use of any third-party site or service is governed by that party’s own terms.

8. Disclaimers

THE SITE AND THE INFORMATION IT CONTAINS ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, CLARUS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND TITLE.

We do not warrant that the Site will be uninterrupted, secure, or error-free, or that the content is accurate, complete, or current. Cleaning services are subject to the separate scope and terms of your written quote, work order, or service agreement.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, CLARUS, ITS OWNERS, OFFICERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF THE SITE OR FROM ANY SERVICE YOU REQUEST THROUGH IT, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

For any direct claim arising from the cleaning services we provide to you, our total cumulative liability is limited to the amount you actually paid for the specific service that gave rise to the claim. Some jurisdictions do not allow the exclusion or limitation of certain damages, so portions of this section may not apply to you.

10. Indemnification

You agree to defend, indemnify, and hold harmless CLARUS, its owners, employees, and contractors from any claims, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising from your violation of these Terms, your misuse of the Site, or your violation of any law or third-party right.

11. Modifications and Discontinuation

We may update, modify, or discontinue any portion of the Site at any time without notice. We may also amend these Terms; if we do, we will post the updated version with a new "last updated" date. Your continued use of the Site after the effective date of an update means you accept the updated Terms.

12. Governing Law and Venue

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law provisions. Any dispute arising from or relating to the Site or our services will be resolved exclusively in the state or federal courts located in Lee County, Florida, and you consent to the personal jurisdiction of those courts.

13. Severability and Waiver

If any provision of these Terms is held to be unlawful or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will remain in full force and effect. Our failure to enforce any provision is not a waiver of that provision or of our right to enforce it later.

14. Entire Agreement

These Terms, together with our Privacy Policy and any written quote or service agreement we provide to you, constitute the entire agreement between you and CLARUS regarding your use of the Site and our cleaning services, and supersede any prior or contemporaneous communications on those subjects.
